TERMS AND CONDITIONS

Terms of Agreement It is agreed that the following terms set out the total agreement between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. Booking Fee A non-refundable Wedding Booking Fee of £200 is charged when the client signs this contract. This fee is deducted in full from the TOTAL price. Payments Following payment of the booking fee, the remainder balance is due to be paid 30 days before the date of the wedding/event as detailed in the schedule. Payment for additional images is to be made when they are ordered. Cancellation In the unfortunate event of cancellation of the wedding/event by the client, if notice of 30 days or more is given, the deposit will be retained and the contract cancelled. If notice of less than 30 days is given, the client will be subject to the total cost of the wedding photography initially booked. Display The client hereby allows Rebecca Fennell photography to display any images included in this contract in their portfolio, literature, wedding exhibitions, website and advertising. Rebecca Fennell photography will make no use of the images for other commercial reasons except with the written permission of the client. Images All image sizes are nominal and produced in colour unless otherwise stated. Rebecca Fennell photography will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by combination of certain dyes and materials, especially man made fibres. It is sometimes impossible to capture the exact colour as seen by the human eye. Retouching Retouching, digital manipulation and artist finishing is available to the client as an optional extra. Re-orders All re-orders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing. Once an order is placed, the client is responsible for this purchase and liable for the total cost of all prints and any p&p charges that are applicable. Please ensure your order is correct prior to placing this order. If unsure please contact us in order for us to make the correct re-order. Refund/Returns Rebecca Fennell photography does not offer refunds or accept returns on re-ordered prints. All prints ordered are NON RETURNABLE or REFUNDABLE. Delivery/Posting Policies All wedding proofs/albums are delivered personally where available or otherwise by courier. All re-ordered prints are posted 1st class post or by special delivery/recorded delivery upon request. Please contact us for a quote of postage costs, as they vary on quantities ordered, prior to placing an order. Copyright Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allowed to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of Rebecca Fennell photography in writing. License Rebecca Fennell photography shall be granted artistic license in relation to the poses photographed and locations used. Rebecca Fennell photography’s judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of weather and the willingness of subjects it may not be possible to capture all the images requested. Rebecca Fennell photography’s judgement regarding relevance or non-relevance of subject matter shall be deemed correct unless specifically informed. Rebecca Fennell photography will endeavour to capture as much of what is relevant to the event as possible. However, Rebecca Fennell photography cannot guarantee everything will be recorded. Force Majeur or Act of God The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Limitation of Liability In the likely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Negatives/Digital Files Negatives and Digital files remain the property of Rebecca Fennell photography. Complaints In the unlikely event of there being any complaints, these should first be raised by the client with Rebecca Fennell photography in writing within 21 days from the date of receipt of images.
